Regulation No. 667/2011 on general exemptions from the freedom to provide services in Iceland without establishment

Aricle 1

The provisions of Article 13 of the Act on services in the internal market of the European Economic Area shall not apply to:

  1. services of general economic interest;
  2. matters covered by Directive 96/71/EC of the European Parliament and of the Council of 16 December 1996 concerning the posting of workers in the framework of the provision of services, as transposed into Icelandic law;
  3. matters covered by Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, as transposed into Icelandic law;
  4. matters covered by Directive 77/249/EEC of 22 March 1977 to facilitate the effective exercise by lawyers of freedom to provide services, as transposed into Icelandic law;
  5. the activity of judicial recovery of debts;
  6. matters covered by Title II of Directive 2005/36/EC of the European Parliament and of the Council of 7 September 2005 on the recognition of professional qualifications, as transposed into Icelandic law;
  7. requirements which reserve an activity to a particular profession;
  8. matters covered by Council Regulation (EEC) No 1408/71 on the application of social security schemes to employed persons, to self-employed persons and to members of their families moving within the Community, as transposed into Icelandic law;
  9. administrative formalities concerning the free movement of persons and their residence covered by the provisions of Directive 2004/38/EC of the European Parliament and of the Council of 29 April 2004 on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States, as transposed into Icelandic law;
  10. requirements stipulating that nationals of countries outside the European Economic Area must have visas or residence permits or need to report to the Icelandic authorities, in accordance with the Schengen Agreement;
  11. matters covered by Council Regulation (EEC) No 259/93 of 1 February 1993 on the supervision and control of shipments of waste within, into and out of the European Community, as transposed into Icelandic law;
  12. copyright, neighbouring rights and matters covered by Council Directive 87/54/EEC of 16 December 1986 on the legal protection of topographies of semiconductor products, as transposed into Icelandic law, and by Directive 96/9/EC of the European Parliament and of the Council of 11 March 1996 on the legal protection of databases, as transposed into Icelandic law, as well as industrial property rights;
  13. acts requiring by law the involvement of a notary;
  14. matters covered by Directive 2006/48/EC of the European Parliament and of the Council of 17 May 2006 on statutory audit of annual accounts and consolidated accounts, as transposed into Icelandic law;
  15. the registration of vehicles leased in another EEA Member State;
  16. provisions regarding contractual and non-contractual obligations, including the form of contracts, determined pursuant to the rules of private international law.

Article 2

This Regulation is issued on the basis of Article 13(6) of Act No 76/2011 on services in the internal market of the European Economic Area and is effective immediately.
